These Terms constitute a public offer and govern your access to and use of aspersteel.com, as well as orders placed through the website. By using the Site or placing an order, you accept these Terms.

1. Definitions

“Company,” “we,” “us”: UTMK POLSKA LIMITED LIABILITY COMPANY.
“Site”: aspersteel.com and subdomains.
“User,” “you”: any visitor, registered customer, or entity using the Site.
“Products/Services”: items and services listed on the Site.

2. Eligibility

You must be at least 18 and authorized to bind your organization (for B2B orders). By using the Site, you represent that you meet these requirements.

3. Accounts

You are responsible for your account credentials, activity under your account, and keeping information accurate. Notify us immediately of any unauthorized use.

4. Orders & Acceptance

Placing an order constitutes an offer to buy. We may accept or reject any order at our discretion (e.g., availability, pricing/typographical errors, compliance checks). Contract is formed upon our order confirmation (email) and receipt of payment per the chosen method.

5. Prices, Taxes & Payment

Prices are shown exclusive of applicable taxes unless stated otherwise. We may change prices at any time prior to order acceptance. You are responsible for VAT and other taxes/duties per destination rules. Payments are processed by third-party processors; additional terms may apply.

6. Shipping, Delivery & Risk

Estimated delivery dates are indicative. Title and risk of loss pass upon delivery to the carrier or to you, depending on Incoterms specified in your order confirmation. You must inspect goods upon delivery and notify us of discrepancies within 5 business days.

7. Cancellations, Returns & Refunds

You may request cancellation before dispatch.
Returns are accepted for eligible items in original condition within 14 days of delivery unless the order/quotation states otherwise or the items are custom-made.
Refunds are processed to the original payment method after inspection. Shipping costs are non-refundable unless legally required.

8. Product Information & Availability

We strive to ensure accuracy, but specifications, dimensions, and availability are subject to change. Minor deviations consistent with industry tolerances do not constitute non-conformity.

9. Acceptable Use

You agree not to misuse the Site, including: introducing malware, scraping without permission, circumventing security, infringing IP, or violating laws/sanctions.

10. Intellectual Property

All content on the Site (design, text, graphics, logos, product data) is owned by us or our licensors and protected by applicable IP laws. You receive a limited, revocable, non-transferable license to access and use the Site for its intended purpose.

11. Warranties & Disclaimers

Except as expressly stated in a specific product warranty or order confirmation, the Site and Products are provided “as is” without warranties of any kind, to the fullest extent permitted by law.

12. Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or business, arising from or related to your use of the Site or Products. Our aggregate liability for any claim is limited to the amount you paid for the Product giving rise to the claim.

13. Compliance & Sanctions

You represent that you are not subject to applicable sanctions and will not use the Products in prohibited end-uses. We may suspend or cancel orders to comply with laws.

14. Data Protection

Processing of personal data is governed by our Privacy Policy and Cookie Policy, which form part of these Terms.

15. Force Majeure

We are not responsible for delays/failures due to events beyond our reasonable control (e.g., natural disasters, war, strikes, outages).

16. Governing Law & Dispute Resolution

These Terms are governed by the laws of Poland. The courts of Warsaw, Poland shall have exclusive jurisdiction, without prejudice to mandatory consumer rights.

17. Changes

We may update these Terms at any time by posting a new version on the Site. Continued use after changes constitutes acceptance.
